Terms of Service
Effective date: October 25, 2026
These Terms of Service (the "Terms") are a legally binding agreement between you and MKE Shirt Club ("MKE Shirt Club," "we," "us," or "our"). They govern your access to and use of mkeshirtclub.com, the Design Studio, creator stores, the partner portal, and all related features, content, and services (together, the "Platform"). By creating an account, placing an order, uploading content, listing a product, or otherwise using the Platform, you agree to these Terms, our Privacy Policy, and our Shipping & Returns Policy, which are part of these Terms. If you do not agree, do not use the Platform.
Please read Section 19 (Dispute Resolution) carefully. It requires most disputes to be resolved through individual binding arbitration and includes a waiver of class actions, unless you opt out as described there.
You own your art
MKE Shirt Club does not own your designs. You keep all ownership and copyright in the artwork, text, logos, photos, and other content you create or upload. You give us only the limited license described in Section 6.2 so we can print, display, and sell your products. That license ends for future use when you remove your content, except as stated in Section 6.2. You are solely responsible for your content, including making sure you have every right needed to use it (Section 6.3).

- "Customer" means a User who purchases a Product.
- "Creator" means a User who creates a storefront and lists designs for sale.
- "Partner" means a business enrolled in our referral partner program.
- "Your Content" means any artwork, image, text, logo, design, photo, store information, review, message, or other material you create, upload, submit, or display on the Platform.
- "Product" means any shirt or other item offered on the Platform, including custom designs ordered through the Design Studio and Creator listings.
- "Print Partners" means the local print shop and other printing and fulfillment providers we use to produce and ship Products.
2. Eligibility
- You must be at least 13 years old to use the Platform. You must be at least 18 years old, or the age of majority where you live, to place orders, sell as a Creator, or join the partner program. Users under 18 may only use the Platform with the involvement and consent of a parent or legal guardian, who agrees to these Terms on their behalf.
- You may not use the Platform if you have been previously suspended or banned from it, or if you are barred from receiving services under applicable law.
- We currently sell and ship Products only to addresses in the United States.
- If you use the Platform on behalf of a business, you confirm you are authorized to bind that business to these Terms.
3. Accounts and Security
- You must give accurate, current, and complete information and keep it up to date. You may not impersonate anyone or create an account for someone else without permission.
- You are responsible for all activity under your account and for keeping your login credentials confidential. Notify us immediately at customerservice@mkeshirtclub.com of any unauthorized use. We are not liable for losses caused by unauthorized use of your account where you failed to keep your credentials secure.
- One person may not operate multiple accounts to get around limits, plan restrictions, rewards rules, or enforcement actions.
- Accounts are personal and may not be sold, transferred, or shared.
4. Orders, Pricing, Payment, and Taxes
4.1 Made-to-order products
Every Product is printed to order. Product images, color swatches, and mockups are illustrations; actual colors, print placement, and print size may vary slightly due to screens, materials, printing methods, and shirt size.
4.2 Order acceptance
Your order is an offer to buy. We accept it when we begin production or send a shipping confirmation. We may refuse or cancel any order, in whole or in part, including if a Product is unavailable, mispriced, suspected of being fraudulent, contains content that violates these Terms, or cannot be produced. If we cancel an order you have paid for, we will refund the amount paid for the cancelled portion.
4.3 Prices and errors
Prices are in U.S. dollars and may change at any time. Larger sizes may carry an additional charge shown before checkout. We make every effort to show accurate prices, descriptions, and delivery estimates, but errors can occur; if one does, we may correct it, cancel the affected order, and refund any payment, even after an order is placed.
4.4 Payment
You authorize us and our payment processors to charge the payment method you provide for the total order amount, including Product prices, size charges, shipping, rush or same-day fees, and taxes. You confirm you are authorized to use that payment method.
4.5 Taxes
We collect sales tax where required by law. You are responsible for any other taxes that apply to your purchases or earnings.
4.6 Chargebacks
If you believe a charge is wrong, please contact us first; most issues can be fixed quickly under our Shipping & Returns Policy. Filing an unjustified chargeback or payment dispute may lead to suspension of your account, and we may contest it and recover associated fees.
5. Shipping, Title, and Risk of Loss
Shipping methods, delivery estimates, rush printing, same-day local delivery, cancellations, reprints, and refunds are described in our Shipping & Returns Policy. Delivery dates are estimates unless we expressly promise a date for rush or same-day service. Title to and risk of loss for Products pass to you when we deliver them to the carrier or, for local delivery, when they are delivered to your address. Our reprint-or-refund promise for lost, damaged, and misprinted items still applies as described in that policy.
6. Your Content and Intellectual Property
6.1 You keep ownership
As between you and us, you retain all right, title, and interest, including all copyrights and other intellectual property rights, in Your Content. Nothing in these Terms transfers ownership of Your Content to MKE Shirt Club.
6.2 License you grant us
To operate the Platform, you grant MKE Shirt Club a non-exclusive, worldwide, royalty-free, sublicensable (only to our Print Partners, carriers, and service providers acting for us) license to host, store, reproduce, resize, reformat, crop for production, print, display, and distribute Your Content solely to:
- produce, print, package, and ship Products you or Customers order;
- display Your Content on the Platform, including in your storefront, listings, previews, mockups, search results, and share-link previews;
- market and promote your listings and the Platform, including on social media, in email, and in advertising, with attribution to you where reasonably practical; and
- create print files, backups, and records needed to provide the services, comply with law, and resolve disputes.
This license ends when you delete the content or your account, except that it continues (i) for orders placed before deletion, (ii) for marketing materials already created or published, (iii) for archival, legal, and record-keeping copies, and (iv) as needed to investigate or resolve violations or claims. We will not sell Your Content as a standalone item or license it to third parties to sell.
6.3 You are solely responsible for Your Content
You are solely responsible for Your Content and for the consequences of uploading, listing, and selling it. MKE Shirt Club does not pre-screen all content, does not verify ownership or rights, and is not responsible or liable for any content uploaded by Users, including any claim that it infringes, misappropriates, or violates the rights of any third party. By uploading or listing content, you represent and warrant that:
- you own Your Content or have obtained every license, permission, consent, and release necessary to use it and to grant the license in Section 6.2;
- Your Content, and our use of it as permitted by these Terms, does not and will not infringe, misappropriate, or violate any copyright, trademark, trade dress, patent, trade secret, right of publicity or privacy, or any other right of any person or entity;
- you have written permission from every identifiable person shown in Your Content to use their name, image, or likeness;
- Your Content complies with these Terms and all applicable laws; and
- all information you provide about Your Content and your listings is accurate.
If you do not hold these rights, you must not upload the content. You agree to defend, indemnify, and hold harmless MKE Shirt Club from claims arising from Your Content as described in Section 18.3.
6.4 Our content and marks
The Platform's software, design, text, graphics, built-in design elements, logos, and the MKE Shirt Club name and marks are owned by us or our licensors and protected by law. You may use built-in graphics and fonts only within the Design Studio for Products ordered or sold on the Platform. You may not copy, modify, scrape, resell, or create derivative works of the Platform except as these Terms allow.
6.5 Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
7. Prohibited Content
You may not upload, list, or order Products with content that:
- infringes any copyright, trademark, or other intellectual property right, including unlicensed sports team, school, brand, band, movie, TV, game, or character names, logos, or artwork, and "inspired by" designs that copy protected elements;
- uses any person's name, photo, likeness, or signature without their permission, including celebrities and public figures, in a way that suggests endorsement or violates publicity rights;
- promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or other protected characteristic;
- harasses, threatens, bullies, or defames anyone, or reveals private or personal information (doxxing);
- is sexually explicit or pornographic, or sexualizes minors in any way;
- glorifies or promotes terrorism, violent extremism, self-harm, or illegal drugs, or depicts graphic violence;
- is fraudulent, deceptive, or misleading, including counterfeit or "replica" goods;
- contains malicious code, hidden data, or files designed to harm systems or people; or
- otherwise violates any law or regulation, or that we reasonably determine is objectionable or exposes MKE Shirt Club, its Users, or its partners to harm or liability.
We decide, in our sole discretion, whether content violates this Section.
8. Prohibited Conduct
You agree not to:
- place fraudulent orders, use stolen payment methods, or make unjustified chargebacks;
- manipulate sales, reviews, ratings, rankings, rewards, referrals, or partner credit, including through fake accounts, self-purchases, self-referrals, or paid or incentivized reviews;
- sell, or attempt to sell, other people's designs or content you do not have rights to;
- interfere with, disrupt, overload, probe, scan, or attempt to gain unauthorized access to the Platform, other accounts, or our systems or networks;
- upload viruses, malware, or harmful files, or attempt to bypass our upload checks or security measures;
- scrape, crawl, copy, or harvest data or content from the Platform by automated means without our written permission;
- circumvent plan limits, fees, or enforcement actions, including by creating new accounts after suspension;
- contact Customers to take sales off the Platform, or misuse any Customer information you receive;
- harass or abuse our staff, Print Partners, or other Users; or
- use the Platform for any unlawful purpose or in any way that violates these Terms.
9. Our Rights to Investigate and Enforce
To protect our Users, our partners, and the integrity, security, and functionality of the Platform, we reserve the right, in our sole discretion and at any time, with or without notice, to take any one or more of the following actions:
- Investigate any suspected violation of these Terms, fraud, infringement, security issue, or unlawful activity, including reviewing accounts, content, orders, transactions, and activity logs;
- Remove, disable, reject, or edit any content, design, listing, review, or storefront information;
- Cancel or refuse any order, and refund Customers in full or in part;
- Withhold, hold, delay, or permanently forfeit payouts, earnings, partner shares, or rewards connected to fraudulent, malicious, infringing, or prohibited sales or activity, and reverse earnings already credited;
- Limit features, listings, or account functions, or place an account under review;
- Suspend or terminate any account, and ban any person, business, device, or payment method from the Platform, including related or duplicate accounts;
- Preserve and disclose information to law enforcement, regulators, rights holders, payment processors, or others when we believe in good faith it is required by law or necessary to protect the rights, property, or safety of MKE Shirt Club, our Users, or the public;
- Recover amounts owed to us, including refunds, chargebacks, fees, and costs caused by your violation, by deducting them from your earnings or by other lawful means; and
- take any other action we consider necessary to prevent harm, comply with law, or preserve the operation, security, and reputation of the Platform.
We are not obligated to monitor the Platform or to take any of these actions, and our decision not to act in one case does not waive our right to act in another. To the fullest extent permitted by law, we are not liable to you or anyone else for any action we take, or decline to take, under this Section in good faith.
10. Copyright and Trademark Complaints; Repeat Infringers
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (DMCA) and applicable trademark law. If you believe content on the Platform infringes your rights, send a notice to customerservice@mkeshirtclub.com with the subject "Copyright/Trademark Notice" that includes:
- your physical or electronic signature;
- identification of the copyrighted work or trademark you claim is infringed;
- the URL or other information sufficient to locate the allegedly infringing material;
- your name, address, telephone number, and email address;
- a statement that you have a good-faith belief the use is not authorized by the rights owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights owner or authorized to act on the owner's behalf.
We may remove or disable the material and notify the User who posted it. A User who believes material was removed by mistake or misidentification may send a counter-notice containing the information required by 17 U.S.C. § 512(g). Knowingly false notices or counter-notices may expose the sender to liability.
Repeat infringer policy. We will terminate, in appropriate circumstances, the accounts of Users who repeatedly infringe or are repeatedly the subject of valid infringement notices, and we may withhold related earnings as described in Section 13.
11. Creator Program
- Relationship. Creators are independent sellers and not employees, agents, partners, or joint venturers of MKE Shirt Club. You set your retail prices within the limits shown on the Platform.
- What we do. We handle payment collection, printing, shipping, customer service, and returns for orders of your Products, under our policies.
- Listing review. We may review, approve, decline, pause, or remove listings, and we may require changes before a listing goes live. Approval does not mean we have verified your rights to the content.
- Print options. Some print options are produced by our Print Partners and have different base costs, available colors, print areas, and delivery times, which are shown when you create a listing. Printed size and placement may vary slightly by shirt size and Print Partner.
- Customer information. Any Customer information you receive may be used only to fulfill your obligations on the Platform and never for unsolicited marketing.
- Storefronts. Your storefront name, URL, and profile must not be misleading or infringe others' rights. We may reclaim or change a store URL that violates these Terms or is reserved.
12. Plans, Subscriptions, and Fees
- Plans. We offer a Free plan and a paid Pro plan. Each plan's product limits, base costs, features, and pricing are shown on the Plan page in your dashboard and may change as described below.
- Automatic renewal. Pro is billed monthly in advance and renews automatically until you cancel. By subscribing, you authorize us and our payment processor (Stripe) to charge your payment method each billing period.
- Cancellation. You can cancel anytime from Dashboard → Plan → Manage billing. Cancellation takes effect at the end of the current billing period, and Pro remains active until then.
- Extra product fees. Listings beyond your plan's included limit carry a one-time fee per listing, shown before you confirm, which is added to your next bill.
- No refunds. Subscription fees and listing fees are non-refundable, including for partial periods or unused features, except where required by law or where we terminate your account without cause.
- Failed payments. If a payment fails, we may retry it and may downgrade your account if it is not resolved.
- Downgrades. When Pro ends, listings over the Free limit, listings priced below the Free base cost, and listings that use Pro-only features are paused (not deleted) and Pro-only storefront features are hidden. You may restore them by upgrading again.
- Changes. We may change plan features, limits, base costs, and prices. We will give at least 30 days' notice of price increases for active subscriptions, which take effect at your next billing period after the notice. Base cost changes apply to sales made after the change.
13. Creator Earnings, Payouts, Holds, and Reversals
- Earnings. For each Product sold, you earn your retail price minus the applicable base cost for your plan, print option, and size. Shipping, taxes, and fees collected from Customers are not part of your earnings.
- When earnings are available. Earnings become available for payout after the order is delivered and any applicable return or dispute period has passed. Cancelled, refunded, charged-back, or fraudulent orders do not earn, and earnings already credited for them will be reversed.
- Payouts. We pay available earnings using a method we agree on with you, on our payout schedule. You must give accurate payout and tax information. We may require identity or tax verification (such as a Form W-9) before any payout, and we may report payments to tax authorities as required.
- Holds and reserves. We may place a hold on, delay, or establish a reserve against your earnings if we reasonably suspect fraud, infringement, a policy violation, unusual activity, elevated refund or chargeback risk, or if a claim or investigation is pending.
- Withholding and forfeiture. We may permanently withhold earnings connected to fraudulent, malicious, infringing, or prohibited sales or activity, and amounts needed to cover refunds, chargebacks, fees, penalties, claims, and costs caused by your listings or conduct.
- Offset and recovery. We may deduct any amount you owe us from your current or future earnings. If your earnings are not enough, you agree to pay the balance on request.
- Taxes. You are solely responsible for reporting and paying all taxes on your earnings.
- Errors. We may correct any overpayment or calculation error, including by adjusting future payouts.
14. Referral Partners
Partners earn a share of eligible orders placed through their referral link or QR code under the partner program terms provided to them. Partner shares follow the same availability, hold, reversal, and withholding rules as Creator earnings in Section 13. Partners receive only order-level information and never Customers' personal details. We may change or end the partner program, or remove any Partner, as described in Section 20.
15. Rewards, Invites, and Promotions
- Reward points have no cash value, are not property, cannot be sold, transferred, or exchanged for cash, and may be used only as a discount on the Platform as we describe.
- Invite rewards are for genuine referrals of new customers. Points obtained through fake or duplicate accounts, self-referrals, or other abuse may be removed, and the related accounts may be suspended.
- Promo codes and invite discounts are subject to the conditions shown with them, cannot be combined unless stated, have no cash value, and may be ended or changed at any time.
- We may change, suspend, or end any rewards or promotional program at any time. If we end the points program, we will give reasonable notice and an opportunity to use earned points where required by law.
- Points are forfeited when an account is closed or terminated.
16. Third-Party Services
The Platform relies on third parties, including payment processors, shipping carriers, Print Partners, and hosting and email providers, and may link to third-party websites such as social networks. Their services are governed by their own terms, and we are not responsible for their acts, omissions, content, or availability.
17. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND OUR SHIPPING & RETURNS POLICY, THE PLATFORM, PRODUCTS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT USER CONTENT IS ACCURATE OR LAWFUL, OR THAT ANY CREATOR HAS THE RIGHTS TO THE DESIGNS THEY SELL. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
18. Limitation of Liability; Indemnification
18.1 Exclusion of certain damages
TO THE FULLEST EXTENT PERMITTED BY LAW, MKE SHIRT CLUB AND ITS OWNERS, EMPLOYEES, AGENTS, PRINT PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SALES, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE PLATFORM, ANY PRODUCT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
18.2 Liability cap
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). WE ARE NOT LIABLE FOR ANY CONTENT UPLOADED, LISTED, OR SOLD BY USERS, OR FOR ANY CLAIM THAT USER CONTENT INFRINGES THE RIGHTS OF ANY THIRD PARTY. Nothing in these Terms limits liability that cannot be limited under applicable law.
18.3 Indemnification
You agree to defend, indemnify, and hold harmless MKE Shirt Club and its owners, employees, agents, Print Partners, and service providers from and against any and all claims, demands, lawsuits, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- Your Content, including any image, design, text, or other material you upload, list, or order, and any claim that it infringes, misappropriates, or violates any copyright, trademark, right of publicity or privacy, or other right;
- your listings, sales, and any Products made from Your Content;
- your breach of these Terms or of any representation or warranty you make;
- your violation of any law or the rights of any third party; and
- your use or misuse of the Platform.
We may assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any such matter without our prior written consent.
19. Dispute Resolution
19.1 Informal resolution first
Before filing any claim, you agree to contact us at customerservice@mkeshirtclub.com with a description of the dispute and to try in good faith to resolve it informally for at least 30 days.
19.2 Binding individual arbitration
If we cannot resolve a dispute informally, you and MKE Shirt Club agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may (a) bring an individual claim in small claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect intellectual property rights or to stop unauthorized use of the Platform. The arbitration will take place in Milwaukee County, Wisconsin, or remotely, unless the arbitrator decides otherwise.
19.3 Class action waiver
YOU AND MKE SHIRT CLUB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
19.4 Opt-out
You may opt out of this arbitration agreement by emailing customerservice@mkeshirtclub.com with your name, account email, and a clear statement that you opt out of arbitration, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
19.5 Governing law and venue
These Terms are governed by the laws of the State of Wisconsin and applicable federal law, without regard to conflict-of-law rules. For any dispute not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Milwaukee County, Wisconsin.
20. Termination
- By you. You may stop using the Platform and close your account at any time from My Account → Profile → Close account. Closing requires that no orders are in progress and that creator earnings have been settled.
- By us. We may suspend or terminate your account or access to all or part of the Platform at any time, for any reason, including violation of these Terms, suspected fraud or infringement, risk to other Users or the Platform, extended inactivity, or as required by law, with or without notice.
- Effect. On termination, your right to use the Platform ends immediately; your listings may be removed; unused reward points are forfeited; and we may withhold earnings as described in Section 13. Earnings that are not subject to withholding will be paid out after any hold period, less amounts you owe us.
- Survival. Sections 6.3, 6.4, 9, 10, 13, and 17 through 21, and any other provisions that by their nature should survive, survive termination.
21. General Terms
- Changes to these Terms. We may modify these Terms at any time. We will post the updated Terms with a new effective date and, for material changes, notify account holders by email or on the Platform. Changes take effect when posted unless stated otherwise. Continued use after changes take effect means you accept them.
- Changes to the Platform. We may add, change, suspend, or discontinue any part of the Platform at any time.
- Electronic communications. You agree to receive communications from us electronically, and that such communications satisfy any legal requirement that they be in writing.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier or Print Partner disruptions, supply shortages, power or internet outages, labor disputes, or government actions.
- Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Entire agreement. These Terms, together with the policies they reference and any plan or partner terms shown to you, are the entire agreement between you and us about the Platform and supersede any prior agreements.
- Headings. Section headings are for convenience only and do not affect interpretation. "Including" means "including without limitation."
